The following are representative of Rich's accomplishments and experience:

Appeals, Commercial Litigation, Construction and Surety

  • Represented product liability plaintiff in successful appeal to the United States Court of Appeals for the Second Circuit reversing dismissal of case based on forum non conveniens.Irragori v. International Elevator, Inc., 243 F.3d 678 (2d Cir. 2001).
  • Represented equipment supplier in successfully defending $17 million mechanic’s lien in appeal to the Connecticut Supreme Court. Alstom Power, Inc. v. Balcke-Durr, Inc., 269 Conn. 599 (2004).
  • Represented wife in appeal to Connecticut Appellate and Supreme Courts in divorce case challenging appealability of interlocutory order requiring her spouse to pay over $400,000 in legal fees. Perricone v. Perricone, AC 25461
  • Expanded law with respect to Eichleay formula used to calculate extended home office overhead damages arising out of owner-caused delays on federal construction projects. West v. All-State Boiler, 146 F.3d 1468 (Fed. Cir. 1998).
  • Expanded law with respect to obligations of commercial tenants operating under percentage rent leases. Pequot Spring Water Co. v. Brunelle, 46 Conn. App. 187 (1997), cert. granted, in part, 243 Conn. 928 (1997).
  • Obtained new trial for pro bono client in criminal appeal. State v. Jones, 39 Conn. App. 563; 1995 cert. den. 235 Conn. 931 (1995).
  • Representation of ENR 400 contractor against multiple subcontractor claims arising out of $100 million federal prison construction project.
  • Representation of an international EPC contractor in $65 million claim for additional compensation (and defense or owner's counterclaim) arising out of an oil refinery project in Singapore .
  • Representation of an international EPC contractor against owner's claims for cost overruns arising out of the design and construction of a $1.1 billion gold/ore processing facility in Argentina .
