ACCOMPLISHMENTS AND EXPERIENCE:

The following are representative of Daniel’s accomplishments and experience:

Appellate Litigation

  • Represented national publisher of legal newspapers and magazines in federal court appeal challenging Connecticut Judicial Branch practice of secretly sealing docket sheets in thousands of cases. Hartford Courant Company v. Pellegrino, 371 F.3d 49 (2d Cir. 2004).
  • Represented major Hartford , CT law firm in successful appeal to Connecticut Supreme Court, resulting in reversal of $16 million legal malpractice award and entry of judgment in favor of law firm. Beverly Hills Concepts v. Schatz & Schatz, Ribicoff & Kotkin , 247 Conn. 48 (1998)
  • Represented nationwide coalition of local independent telephone companies in appeal to the United States Supreme Court challenging the jurisdiction of the Federal Communications Commission to promulgate rate-making rules under the Telecommunications Act of 1996. AT&T Corp. v. Iowa Utilities Bd. , 525 U.S. 366 (1999).
  • Represent wife in divorce case appeal challenging the appealability of an interlocutory order directing spouse to pay her over $400,000 in legal fees. Perricone v. Perricone.

Media & Privacy Litigation

  • Currently representing individual in federal court lawsuit against America Online and Fairfield Police Department for violating his privacy by releasing his subscriber information in violation of the Fourth Amendment and the Electronic Communications Privacy Act.
  • Represented newspaper reporter in proceeding to quash subpoena requiring her to testify about her post-verdict conversations with a juror.
  • Regularly represent newspapers in defamation and invasion of privacy actions.
