U.S. Supreme Court Hears Oral Argument in New London Taking Case

The U.S. Supreme Court heared oral argument today in the controversial "takings" case involving the City of New London's effort to revitalize its downtown by building a convention center, hotel and other developments intended to create jobs and generate tax revenues for the City.

The legal controversy at issue in the case is whether the taking of private property for transfer to another private entity for redevelopment purposes constitutes a "public use" under the Fifth Amendment. A majority of the Connecticut Supreme Court, relying on both federal and state court precedents, rejected the claim of several New London home owners that the intended transfer of the property to a private entity disqualified the taking as a public use."
